1. Agreement to Terms

By accessing or using the OnPointPerformance PLLC website, patient portal, or any services provided by OnPointPerformance PLLC ("OnPoint," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all visitors, patients, and others who access or use our services, including telehealth consultations, membership subscriptions, lab services, and any related online platforms.

2. Telehealth Services & Medical Disclaimer

OnPointPerformance PLLC provides telehealth-based hormone optimization, wellness, and preventative care services to patients physically located in Texas or Florida at the time of service.

All clinical decisions, including prescribing, are made solely at the discretion of your licensed provider based on your individual health history, labs, and clinical presentation. Protocols described on this website are representative examples and may not reflect your personalized treatment plan.

3. Eligibility

To use OnPointPerformance PLLC services, you must:

• Be at least 18 years of age
• Be physically located in Texas or Florida at the time of your telehealth visit
• Provide accurate, complete, and current personal and medical information
• Have a valid form of payment on file

OnPointPerformance PLLC reserves the right to refuse service to any individual who does not meet eligibility criteria or who provides false or misleading information.

4. Membership & Billing

An active monthly membership ($150/month) is required to receive and maintain any prescription through OnPointPerformance PLLC. By enrolling in a membership, you authorize OnPointPerformance PLLC to charge your payment method on a recurring monthly basis until cancellation.

• Membership may be cancelled at any time with no long-term commitment required
• Cancellation will take effect at the end of the current billing cycle
• Refunds are not provided for partial months
• Cancellation of membership will result in the inability to receive or refill any active prescriptions
• The initial consultation and lab fee ($250) is non-refundable after purchase

All fees are clearly disclosed prior to purchase. OnPointPerformance PLLC operates on a transparent cash-pay model — no insurance is accepted or billed.

5. Prescriptions & Medications

Prescriptions are issued solely at the clinical discretion of your OnPointPerformance PLLC provider. The presence of a medication or protocol on our website does not guarantee that it will be prescribed to you. All prescriptions require:

• A valid provider-patient relationship
• An active membership subscription
• Current laboratory results reviewed by your provider
• Clinical appropriateness as determined by your provider

Medications are dispensed through third-party licensed compounding or retail pharmacies. Medication costs are billed separately by OnPointPerformance PLLC and are not included in the monthly membership fee.

6. Patient Responsibilities

As a patient of OnPointPerformance PLLC, you agree to:

• Provide accurate, complete, and up-to-date medical and personal information at all times
• Notify your provider of all medications, supplements, and health conditions — including changes since your last visit
• Follow through on ordered lab work in a timely manner
• Attend scheduled telehealth appointments or provide advance notice of cancellation
• Contact your provider or seek emergency care immediately if you experience a medical emergency or adverse symptoms
• Not use OnPointPerformance PLLC services as a replacement for emergency medical care

7. Intellectual Property

All content on the OnPointPerformance PLLC website — including text, graphics, logos, images, and the overall design — is the exclusive property of OnPointPerformance PLLC and is protected by applicable copyright and intellectual property laws. Unauthorized reproduction, distribution, or use of any content is strictly prohibited.

8. Limitation of Liability

To the maximum extent permitted by applicable law, OnPointPerformance PLLC, its providers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to: adverse medication reactions, delays in care, technical failures of the telehealth platform, or reliance on information provided on this website.

OnPointPerformance PLLC's total liability for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you in the three (3) months preceding the event giving rise to the claim.

9. Termination of Services

OnPointPerformance PLLC reserves the right to terminate or suspend your access to services at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other patients or staff, is clinically inappropriate, or for any other reason at our sole discretion. Upon termination, your prescriptions may not be refilled and your membership will be cancelled.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

11. Changes to These Terms

OnPointPerformance PLLC reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services following the posting of changes constitutes your acceptance of the revised Terms.
