1. Agreement to Terms

By accessing or using the OnPoint Performance PLLC website, patient portal, or any services provided by OnPoint Performance PLLC ("OnPoint," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all visitors, patients, and others who access or use our services, including telehealth consultations, membership subscriptions, lab services, and any related online platforms.

2. Telehealth Services and Medical Disclaimer

OnPoint Performance PLLC provides telehealth-based hormone optimization, peptide therapy, medical weight loss including GLP-1 medications, and ongoing performance medicine to patients physically located in Florida or Texas at the time of service. Gretchen Delgado, MSN, APRN, AGACNP-BC is licensed in Florida (autonomous independent practice) and Texas (under medical director).

All clinical decisions, including prescribing, are made solely at the discretion of your licensed provider based on your individual health history, labs, and clinical presentation. Protocols described on this website are representative examples and may not reflect any individual patient's personalized treatment plan.

3. Eligibility

To use OnPoint Performance PLLC services, you must:

• Be at least 18 years of age,
• Be physically located in Florida or Texas at the time of your telehealth visit,
• Provide accurate, complete, and current personal and medical information, and
• Have a valid form of payment on file.

OnPoint Performance PLLC reserves the right to refuse service to any individual who does not meet eligibility criteria, who provides false or misleading information, or whose clinical needs fall outside the scope of our practice.

4. Membership and Billing

An active monthly membership is required to receive and maintain any prescription through OnPoint Performance PLLC. Current membership tiers, pricing, and benefits are described on the Membership page.

By enrolling in a membership, you authorize OnPoint Performance PLLC to charge your payment method on a recurring monthly basis until cancellation.

• Membership may be cancelled at any time. No long-term commitment is required.
• Cancellation takes effect at the end of the current billing cycle. Refunds are not provided for partial months of membership.
• Cancellation of membership will result in the inability to receive new prescriptions or refill existing ones.
• The $250 Initial Health Assessment fee is non-refundable after purchase. It is considered earned at the time of payment, not at the time of scheduling.
• All applicable fees are clearly disclosed prior to purchase.

OnPoint Performance PLLC operates on a cash-pay model. We do not accept, bill, or coordinate with insurance, including Medicare or Medicaid.

5. Prescriptions and Medications

Prescriptions are issued solely at the clinical discretion of your OnPoint Performance PLLC provider. The presence of a medication or protocol on our website does not guarantee that it will be prescribed to you. All prescriptions require:

• An established provider-patient relationship,
• An active membership subscription,
• Current laboratory results reviewed by your provider, and
• Clinical appropriateness as determined by your provider.

Medications are dispensed through third-party licensed compounding or retail pharmacies. Medication costs are billed separately by the dispensing pharmacy at the actual cost of the medication and are not included in the monthly membership fee.

6. Scope of Practice

OnPoint Performance PLLC specializes in hormone optimization, peptide therapy, medical weight loss, and performance medicine for adult patients. We do not provide primary care, treatment for chronic disease as a primary condition, treatment for acute illness, emergency medical services, pediatric or obstetric care, or mental health treatment.

If you require services outside this scope, please consult a primary care provider, an appropriate specialist, or your local emergency services.

7. Patient Responsibilities

As a patient of OnPoint Performance PLLC, you agree to:

• Provide accurate, complete, and up-to-date medical and personal information at all times,
• Notify your provider of all medications, supplements, and health conditions, including changes since your last visit,
• Complete ordered laboratory work in a timely manner,
• Attend scheduled telehealth appointments or provide advance notice of cancellation,
• Contact your provider or seek emergency care immediately if you experience a medical emergency or adverse symptoms,
• Not use OnPoint Performance PLLC services as a replacement for emergency medical care.

8. Acceptable Use

You agree not to use the OnPoint Performance PLLC website, patient portal, or any of our services to:

• Misrepresent your identity, location, or medical history,
• Attempt to access or disrupt the security or integrity of our digital systems,
• Harass, threaten, or harm OnPoint Performance staff, providers, or other patients,
• Use our services in any manner that violates applicable law.

9. Intellectual Property

All content on the OnPoint Performance PLLC website, including text, graphics, logos, images, brand identity elements, and the overall design, is the exclusive property of OnPoint Performance PLLC and is protected by applicable copyright and intellectual property laws. Unauthorized reproduction, distribution, modification, or use of any content is prohibited.

10. Limitation of Liability

To the maximum extent permitted by applicable law, OnPoint Performance PLLC, its providers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to: adverse medication reactions, delays in care, technical failures of any telehealth platform, or reliance on information provided on this website.

OnPoint Performance PLLC's total liability for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you to OnPoint Performance PLLC in the three (3) months preceding the event giving rise to the claim.

11. Termination of Services

OnPoint Performance PLLC reserves the right to terminate or suspend your access to services at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other patients or staff, is clinically inappropriate, or for any other reason at our sole discretion. Upon termination, your prescriptions may not be refilled and your membership will be cancelled.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

13. Changes to These Terms

OnPoint Performance PLLC reserves the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be communicated to active patients through the patient portal or by email. Continued use of our services following the posting of changes constitutes your acceptance of the revised Terms.
